THE MATTER

The client — a mid-market corporate group — came to us with a dispute that was already escalating. A summary of the commercial position, the counterparties involved, and the exposure is set out here, with identifying details removed.

WHAT WAS AT STAKE

Three concerns drove the engagement: the monetary exposure, the precedent an adverse finding would set for other commercial arrangements, and the commercial relationship itself with a counterparty the client would continue dealing with for years.

THE APPROACH

We led from the front of the room. Joshua personally drafted the statement of case and cross-examined the key fact witnesses. Our strategy was evidence-led — we placed the tribunal in the commercial moment the disagreement arose, using contemporaneous documents rather than interpretive argument.

THE OUTCOME

The matter was resolved on terms favourable to the client. The commercial relationship continued afterwards, which was the client's priority from the start. Full details are available under privilege.
